There are two Kelsens: one from the first page of the Pure Theory of Law, which everybody knows, many have read and some have adopted it as the definitive lesson for juridical science; and the rest of his work, which with an unusual and thorough conduct, took him to the last consequences of his methodological principle. In the second Kelsen, one can find difficult assertions to sustain, which however are absolutely compatible with the principles of his pure theory, such as the inexistence of unconstitutional laws or illegal decisions, effectively as a condition of validity, multiplicity of valid meanings of rule of laws, etc. Thus, the dissociation is explained by the evident singularity of the starting point of the Kelsen thought opposed to the elevated complexity of its development. This book aims at assisting in the reading of this classic work of philosophy of law. |
